July 3rd & 4th, 2012 San Diego DUI - Saturation Patrols

Traditionally, the 4th of July is one of the most highly anticipated holidays in the beach areas of San Diego – as well as the rest of the USA. This year in particular however, with a full moon on the night of July 3, 2012, experts in the field are anticipating a very heavy DUI crackdown in Pacific Beach, Mission Beach, Ocean Beach, La Jolla, Del Mar, and all other beach areas throughout San Diego County.

In Pacific Beach, certain San Diego Police Officers are known to just stand at busy intersections, just waiting to pull over motorists for such minor offenses as driving without a front license plate, driving with a burnt out license plate light, driving with a burnt out tail light, brake light, turn signal light, etc. These minor equipment violation stops can turn in to full blown DUI arrests in a matter of seconds if the individual driver had anything to drink that night.

In dealing with the police, individuals may be wise to remember that they generally do not have to agree to performing DUI sobriety tests (follow a pen or finger, count backwards, stand on one leg, look up at the sky, say the A, B, C's, etc). A number of police officers seem to judge sobriety test performance rather strictly – as if drivers were already familiar with the tests.

In many instances, the prosecution's case is weakened – where arrested individuals exercised their right not to perform a number of DUI sobriety tests – including the portable breathalyzer, or PAS test – when 21 years of age or older. (Those under 21 must agree to blow in to a PAS test when stopped on suspicion of violating the zero tolerance laws).

The best advice of all is to simply plan ahead – and to not drive to any destination whatsoever – if you plan on drinking when you get there, especially with the huge DUI crackdown in the beach areas of San Diego on the 3rd and 4th of July, 2012.
