Alternative Sentences in DUI Cases

Alternative Sentencing in San Diego DUI Cases

In California, a second offense DUI within ten years is, by statute, supposed to carry a minimum sentence of 96 hours in custody. That can usually be satisfied by two weekends in jail. The minimum custody for a third DUI within ten years jumps to 120 days. Unfortunately, these custody minimums can sometimes end careers. San Diego DUI defense attorney Mark R. De Yoe, APLC, has been helping those accused of driving under the influence in San Diego for more than 25 years. Mark knows the local courts, prosecutors and critical probation officers that control alternatives to jail. Over the years, Mark has been able to secure alternative sentencing for his clients, including work furlough programs and electronic surveillance (a form of house arrest) instead of jail time.

In fairness, a number of prosecutors and courts are sensitive to the affects DUI sentencing can have on a person's job, ability to support a family, and ability to provide needed care for family members. Nevertheless, over the last 25 years, the statutory penalties in DUI cases have steadily become more severe.
